States Diverge on How to Deal With Health Care Ruling

States took broadly divergent approaches on Tuesday to a federal judge’s ruling that invalidated the Obama health care law, while Congressional Republicans used the decision to build momentum for a vote on repealing the act.

The Senate’s Democratic leaders answered the Republican challenge by saying they would stage a vote on the repeal measure on Wednesday, when they were certain it would be defeated. The Giuseppe zanotti boots, where Republicans won a majority in November’s elections, approved the repeal last month.

“We want to get this out of their system very quickly,” the Senate majority leader, Harry Reid of Nevada, said at a news conference in Washington.

But in a few states that are party to the litigation, Republican governors and attorneys general declared the expansive health care law effectively null as a result of the judge’s ruling. They suggested they would suspend planning and implementation until appeals courts could rule, although they did not provide Air Jordan 9 about what precisely might change or whether they would refund federal planning grants already awarded.

“We’re not going to spend a lot of time and money with regard to trying to get ready to implement that until we know exactly what is going to happen,” said Gov. Rick Scott, the new Republican leader of Florida, where the lawsuit was filed by elected officials from 26 states. “And I hope and I believe that either it will be declared unconstitutional or it will be repealed.”

In Wisconsin, the state’s attorney general, J. B. Van Hollen, a Republican, said he was advising Gov. Scott Walker that “the federal health care law is dead — unless and until it is revived by an appellate Air Jordan.” He added, “Effectively, Wisconsin was relieved of any obligations or duties that were created under terms of the federal health care law.”

Aides to Mr. Walker, a Republican, did not respond to a request for comment.

Jon Hanian, a spokesman for Idaho’s Republican governor, C. L. Otter, said that state now might cancel a meeting scheduled for March to study the establishment of a health insurance exchange, which the law requires in 2014.

“I think it’s fair to say it’s an open question whether they’ll do that,” Mr. Hanian said. “We’ve had two rulings now that have struck this thing down.”

But Democratic governors tended to echo Gov. Peter Shumlin of Vermont, who said his state was “moving ahead at full speed” to carry out the law. And in many states, even Republican officials who are party to the lawsuit chose to tread cautiously.

“We’ll be required to move forward until such time relief is granted or an appellate decision is finalized,” said Gov. Nathan Deal of Georgia. “It’s a victory, but not a complete victory.”

Judge Roger Vinson of Federal District Court in Pensacola, Fla., ruled Monday that the health care act’s requirement that Americans obtain insurance exceeded Congress’ authority to regulate interstate commerce. Unlike a Virginia judge who invalidated that provision Air Jordan 9 in December, Judge Vinson struck down the entire health care act. Two other federal judges have upheld the law.

Judge Vinson noted that Congress had failed to include language in the bill to legally sever portions found unconstitutional from the rest. That, the judge wrote, left him to determine whether other components could function independently of the insurance mandate and whether Congress would have approved the act without that provision.

Comparing the law to “a finely crafted watch,” Judge Vinson wrote that there were “too many moving parts” for him to “dissect out the proper from the improper, and the able-to-stand-alone from the unable-to-stand-alone.”

He issued a declaratory judgment against the entire law, and suggested that the Obama Giuseppe zanotti boots administration view it as the “functional equivalent” of an injunction to suspend its implementation.

The judge acknowledged in a footnote that his reasoning on the question borrowed heavily from a friend of the court brief submitted by the Family Research Council, a conservative Christian advocacy group.

States run a significant risk in suspending planning for the law’s implementation while awaiting a final judgment, presumably from the Supreme Court, in a process that could take up to two Alexander McQueen shoes years. Under several major provisions, the federal government can step in if a state defaults.

Most notably, the law says the federal government will take over the operation of health insurance exchanges, where people can compare and buy health plans, if states do not make adequate progress toward establishing them by Jan. 1, 2013.

The White House has tried to emphasize that Judge Vinson’s ruling will not affect the law’s implementation, at least in Washington, until appellate courts can clarify the confusion.

The Justice Department, which represents the administration in the case, is considering whether to request a stay of the ruling. Regardless, it plans to appeal to the Court of Appeals for the Eleventh Circuit, in Atlanta.

Among other tasks, federal health officials are working to define “essential benefits” to be provided by all insurers, writing regulations for a new long-term care insurance program and weighing dozens of requests from states, employers and labor unions for exemptions from various requirements.

“There has not been any effect on the work being done by this department,” said Richard Sorian, a spokesman for the Department of Health and Human Services.

In Congress, the Senate Republican leader, Mitch McConnell of Kentucky, put forward the repeal measure as an amendment to an aviation industry bill that is now on the Senate floor.

“For all those who supported the health care law, it’s an opportunity to re-evaluate your vote, to listen to your constituents,” Mr. McConnell said in a floor speechMBT Sapatu on Tuesday. He added, “You can say, perhaps: ‘This was a mistake. We can do this better.’ Or you can continue to dismiss the majority of people in this country as not knowing what they’re talking about.”

Senate Democrats, however, dismissed the Republican repeal effort as futile and an unnecessary delay of work on the aviation bill. They said their willingness to consider the measure reflected both a recent agreement among Senate leaders to avoid procedural gridlock and their confidence that the health law would survive.

Democrats said they still intended to work with Republicans to repeal one provision of the law that officials in both parties say would create onerous paperwork requirements for small businesses. “No one is saying that the health care bill should not be fixed in any way,” said Senator Charles E. Schumer of New York, the No. 3 Democrat.

$1 Million to Inventor of Tracker for A.L.S

BOSTON — Tracking the inexorable advance of amyotrophic lateral sclerosis, the deadly neuromuscular ailment better known as Lou Gehrig’s disease or A.L.S., has long been an inexact science — a matter of monitoring weakness and fatigue, making crude measurements of the strength of various UGG Nightfall muscles.

This imprecision has hindered the search for drugs that could slow or block the disease’s progress. But now a neurologist at Beth Israel Deaconess Medical Center here has won a $1 million prize — reportedly the largest ever for meeting a specific challenge in medical research — for developing a reliable way to quantify the small muscular changes that signal progressive deterioration.

The winner, Dr. Seward Rutkove, showed that his method could halve the cost of clinical trials to screen potential drugs for the UGG Classic Cardy 5819 disease, said Melanie Leitner, chief scientific officer of Prize4Life, the nonprofit group that created the competition.

The method does not provide a target in the body at which to aim drugs, nor will it help doctors better diagnose the disease. But Dr. Merit Cudkowicz, a professor of neurology at Massachusetts General Hospital and a chairwoman of the Northeast A.L.S. Consortium, compared Dr. Rutkove’s discovery to the way magnetic resonance imaging expedited the development of drugs for multiple sclerosis.

“You can use this as a tool to screen drugs to see if they will affect survival,” she said, but added, “The ultimate prize is finding a drug that works for A.L.S.”

Dr. Rutkove, 46, who has been treating patients with UGG Nightfall neuromuscular disease for 16 years, took advantage of the way our muscle fibers change electrical currents. With a hand-held device hooked up to electrodes on the patient’s skin, a doctor can send a painless electrical current into a given muscle, then measure the voltage that results.

As A.L.S. spreads, motor neurons die off, causing muscles to atrophy. The deteriorating muscles behave differently from healthy ones, resisting the current more. In studies of humans as well as MBT shoes women rats, Dr. Rutkove showed that these variations were closely correlated with disease progression and length of survival.

“It’s not like it’s the fanciest technology,” he said. “But I truly believe it will help people.”

Dr. Rutkove was inspired to become a doctor when, as a child, he watched his grandfather have an epileptic seizure.

Each year, doctors diagnose about 5,000 new cases of A.L.S. in the United States, according to the National Institutes of Health. Despite decades of clinical trials, the diagnosis remains a death MBT Nama sentence. It paralyzes and suffocates patients while their minds remain intact.

A few patients live for decades — the physicist Stephen Hawking is the best known — but most survive only three to five years after symptoms appear. And riluzole, the only A.L.S. drug approved by the Food and Drug Administration, costs about $10,000 a year and typically extends life by just a few months.

The high cost of clinical trials limits drug companies’ ability to test potential treatments. Researchers must recruit hundreds of patients and run MBT Kimodo trials that last as long as two years just to eliminate a drug from the running.

"The concern has really moved from worries about the sustainability of the economic recovery to [asking] is inflation getting to be a problem and are we importing it from China," said Bill Stone, chief investment strategist at PNC Wealth Management.

In Egypt, a large crowd gathered at central Cairo's Tahrir Square, as protesters ignored incremental moves by the government toward promised changes and renewed their demand for the immediate exit of President Hosni Mubarak.

Yes, the Diner’s Open. How About a Seat at the Counter?

IN a new commercial for Denny’s, a man orders chicken wraps at the counter, and when his waitress replies, “Anything else, hon?” he asks her if she calls everyone that.

“No,” comes the reply — not from the waitress but rather the occupant of the next stool, a man in a frayed trucker cap. “I’m sweetie.”

“Sunshine,” says the guy one stool over.

“Precious,” says the woman next to him.

“Cupcake,” says a woman in a nearby booth.

A burly man on the last stool hesitates, and then says, “Sugar britches.”

When the waitress serves the chicken wraps with a “There you go, hon,” the man who ordered ugg boots says, “Pass the salt, sweetie,” to the trucker, who responds, “Sure, hon.”

The commercial closes with the new slogan for Denny’s: “America’s diner is always open.”

In four spots that premiered recently, Denny’s, which has for much of its 58-year history referred to its establishments as “family restaurants,” eschews that term for “diners.”

Frances Allen, chief marketing officer of Denny’s, said consumers in focus groups were not calling Denny’s a family restaurant.

“People think of the brand as a diner, with great comfort food at a great price, and they feel that incredible warmth and incredible connection to the servers,” Ms. Allen said. “There’s a UGG Nightfall to a diner that is very authentic, very warm, very accepting.”

Denny’s will spend an estimated $50 million to $60 million in 2011 for the campaign, the first for the brand by Gotham, an agency that is part of the Interpublic Group of Companies. Denny’s spent $61.1 million on advertising in the first nine months of 2010, compared with $118.8 million spent by Applebee’s, one of its competitors, according to the most recent data available from Kantar Media, a unit of WPP.

•

To play up the diner theme, the “dinersodes,” as the agency refers to the spots, feature counters more prominently than booths, and depict friendly strangers interacting.

In another spot, which like others highlights value-menu items costing from $2 to $8, a young man explains to his friend on the next stool: “So we have $10. We can get one thing for $8 and one UGG Nightfall for $2, or one thing for six and one for four.”

“Or you could get two things for $4 and one for two,” interjects a man on a nearby stool, gesturing to his plates.

“Or five things for two,” says a man at another stool, with five plates.

“Or one for six and two for two,” adds a mother with two small children from a booth.

The camera returns to the young man who draws his opening hands away from his ears, as if his head were exploding.

The new slogan, “America’s diner is always open,” is meant to connote not merely the kitchen never closing, but also to “open being our attitude and philosophy,” said Peter McGuinness, chief executive of Gotham. Actors in the spots represent a MBT Fanaka swath of ethnicities, ages, and socioeconomic classes.

“We’re open to whomever you are, and we greet customers with open arms and have an open mind,” said Mr. McGuinness.

Harold Butler first opened Danny’s Donuts in Lakewood, Calif., in 1953, changing the name six years later to Denny’s because another chain was called Donut Dan’s.

Its signature breakfast combination plate, the Grand Slam, was first introduced in an Atlanta Denny’s in 1977 as an homage to Hank Aaron, who had broken Babe Ruth’s home run record while playing for the Atlanta Braves three years earlier.

Today there are more than 1,600 locations across the United States and internationally, with 15 percent owned by the company and the remainder by franchisees.

In 2009 and 2010, Denny’s announced in Super Bowl ads that they would serve free Grand Slam breakfasts on a given day the following week. Both years, about two million customers crowded into the restaurant for the free MBT sport 2 shoes, but the chain will neither advertise during the Super Bowl this year nor offer the giveaway.

This is not the first time Denny’s has evoked diners. In the late 1990s, it adopted the slogan “America’s original breakfast diner,” and encouraged franchisees to remodel restaurants with stainless steel exteriors, chrome interiors, neon lighting and checkerboard tile floors.

When many balked at the cost of such renovations, the company suggested a less expensive option with flourishes like jukeboxes and outfitting servers in bowling shirts. By the end of 2000, 342 Denny’s had adopted this approach, while another 64 made the switch to the steel exteriors, according to Denny’s 2000 annual report.

•

That report projected “systemwide remodeling of Denny’s” to the diner concept “over the next few years,” but the chain abandoned the plan, along with the slogan, a few years later. Today, 55 retro Denny’s diners with the steel exteriors remain, all but one owned by franchisees.

Mr. McGuinness, of Gotham, stressed that for the new campaign there is nothing nostalgic about the ads.

“We’re talking about a diner not in the physical sense per se but in a much larger sense, more as a symbol and metaphor,” he said.

Michael Stern, co-author with his wife, Jane Stern, of “Roadfood,” a guide to local eateries across the country, and co-founder of Roadfood.com, said there was a time when, far from having positive associations, restaurateurs avoided the word “diner” at all costs.

“In the ’20s, ’30s, and ’40s, for any restaurant that strove to serve better food the term ‘diner’ was anathema,” Mr. Stern said. “It meant greasy food and the dark and dirty MBT Nuru side of eating out.”

As for whether the term suited Denny’s, Mr. Stern was dubious.

“For most people who think about food at all, when they think of a diner, they think of a place with a unique personality,” Mr. Stern said. “And obviously by definition that cannot be a chain restaurant because it’s not unique.”
